We do NOT upload content on behalf of users, review or approve content before publication, verify copyright ownership before upload, guarantee that content is lawful, or act as publisher or distributor of user content. All content is uploaded solely by users under their own responsibility.
3. User Responsibility for Copyright Compliance
All users are fully and exclusively responsible for ensuring that they own all rights to content uploaded OR have obtained valid written permission/licensing rights, their content does not infringe any third-party copyright, and they comply with all applicable intellectual property laws. Users agree that Nexus City TV bears no responsibility for copyright infringement committed by users.
4. Strict Liability of Uploader
Any person who uploads, streams, broadcasts, or distributes content on Nexus City TV is legally responsible for that content. This includes videos, livestreams, radio streams, music, images, clips, product media, thumbnails, and reuploaded content. The uploader assumes full legal liability for any infringement.
5. Copyright Complaint Procedure
5.1 Direct Notice Requirement
If any person believes their copyright has been infringed, they agree that the first course of action must be directed to the individual uploader or account holder responsible for the content, and NOT Nexus City TV. The rights holder must contact the uploader directly, attempt resolution with the uploader, and request removal or licensing directly from the uploader.
5.2 Nexus City TV Role After Notification
Nexus City TV may only become involved after a formal written complaint is submitted OR evidence of unresolved infringement is provided. Even then, Nexus City TV acts only as a neutral intermediary.
5.3 Takedown Requests (Optional Platform Assistance)
Where required, Nexus City TV may temporarily disable access to content, investigate the complaint, request proof of ownership from uploader, and remove content if infringement is reasonably established. However, Nexus City TV is not legally responsible for determining ownership disputes between parties.
6. No Liability for Copyright Infringement
To the maximum extent permitted by law, Nexus City TV shall NOT be liable for copyright infringement by users, unauthorised uploads, misuse of third-party content, monetary losses caused by infringement, legal disputes between users, or damages arising from infringing material. All liability lies solely with the user who uploaded or distributed the content.
7. Indemnity (Hold Harmless Protection)
Users agree to fully indemnify and hold harmless Nexus City TV, including its owners, directors, employees, moderators, contractors, affiliates, and technology providers against all claims arising from copyright infringement, intellectual property disputes, legal claims by third parties, financial losses, legal fees, court orders, and settlement demands. Users accept full responsibility for any violation they commit.
8. Repeat Infringer Policy
Nexus City TV enforces a strict repeat infringer policy. We reserve the right to issue warnings, remove infringing content, suspend accounts, and permanently ban users. Repeat infringement may result in immediate permanent termination without notice.
9. Content Removal Rights
Nexus City TV reserves the absolute right to remove any content at any time, disable access to infringing material, restrict or suspend accounts, and remove channels or stores. This may be done with or without notice, with or without explanation, at our sole discretion. We are not required to provide prior warning before enforcement.
10. False or Abusive Claims
Users are prohibited from submitting false copyright complaints. Any misuse of the copyright system may result in account suspension, permanent ban, legal liability, and claims for damages against the complainant.
11. Licensing & Platform Rights
By uploading content, users grant Nexus City TV a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, stream, display, promote, and distribute content as part of operating the Platform.
12. Third-Party Copyright Disputes
Nexus City TV is NOT a court of law, a copyright arbitrator, or a mediator between users. All disputes between users must be resolved directly between the parties involved, through legal processes outside the Platform if necessary.
13. No Warranty of Content Legality
Nexus City TV makes no guarantee that uploaded content is legal, properly licensed, or does not infringe third-party rights. Users accept that they interact with content at their own risk.
14. Limitation of Liability
To the fullest extent permitted by law, Nexus City TV shall not be liable for copyright infringement by users, financial losses, legal claims, business damages, content takedowns, account suspensions, or loss of revenue or monetisation.
15. Policy Changes
Nexus City TV may update this Copyright Policy at any time, without notice, without consent. Continued use of the Platform constitutes acceptance of updated terms.
